1. Acceptance of terms
By accessing or using carevista.com.au (the "Website"), you agree to be bound by these Terms of Use ("Terms"). These Terms apply to all visitors and users of the Website. If you do not agree to these Terms, you must not use the Website.
The Website is operated by Carevista Pty Ltd ("Carevista", "we", "us", "our"). These Terms are governed by the laws of New South Wales, Australia.
2. Purpose of the Website
The Website provides general information about aged care providers registered with the Aged Care Quality and Safety Commission (ACQSC). It is an independent comparison tool intended to assist individuals and families in researching Support at Home providers. The Website is not affiliated with, endorsed by, or operated by the Australian Government, the ACQSC, the Department of Health and Aged Care, or My Aged Care.
3. Permitted use
You may use the Website only for lawful purposes and in accordance with these Terms. You must not:
- Use the Website in any way that violates any applicable federal, state, or local law or regulation
- Attempt to gain unauthorised access to any part of the Website or its related systems
- Use automated tools (including bots, scrapers, or crawlers) to systematically extract data from the Website without our prior written consent
- Transmit any unsolicited or unauthorised advertising or promotional material
- Introduce viruses, trojans, worms, or other malicious or technologically harmful material
- Reproduce, distribute, or commercially exploit any Website content without our prior written permission
4. Intellectual property
All content on the Website — including text, graphics, logos, design, code, and compilation of data — is either owned by Carevista or licensed to us, and is protected under the Copyright Act 1968 (Cth) and other applicable intellectual property laws.
Provider data displayed on the Website is sourced from the ACQSC Provider Register, which is published by the Australian Government under open data principles. Carevista makes no claim of ownership over that underlying government data.
Nothing in these Terms grants you any licence or right to use our intellectual property without our prior written consent.
5. No warranties
The Website and its content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law — including under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law — we make no representations or warranties of any kind, express or implied, regarding:
- The accuracy, completeness, currency, or reliability of any information on the Website
- The suitability of any provider listed on the Website for your particular circumstances
- The uninterrupted or error-free operation of the Website
Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.
6. Limitation of liability
To the maximum extent permitted by law, Carevista, its directors, employees, and agents will not be liable for any loss or damage — whether direct, indirect, incidental, special, or consequential — arising out of or in connection with your use of, or inability to use, the Website or its content.
This includes, without limitation, any loss or damage arising from reliance on provider information displayed on the Website, errors or omissions in provider data, or decisions made on the basis of information obtained from the Website.
Where liability cannot be excluded by law, our liability is limited to the maximum extent permitted under the Australian Consumer Law.
7. Third-party links and services
The Website may contain links to third-party websites, including government websites such as agedcarequality.gov.au and myagedcare.gov.au. These links are provided for your convenience only. We do not control those websites and are not responsible for their content, accuracy, or privacy practices. Linking to a third-party website does not imply our endorsement of that website or its operators.
8. Changes to the Website and Terms
We reserve the right to modify, suspend, or discontinue the Website (or any part of it) at any time without notice. We may also update these Terms from time to time. The updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Website after any changes constitutes acceptance of the updated Terms.
9. Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Western Australia and the Federal Court of Australia.
